Arguments in favor of and against food bans are based on public health, animal welfare, and other issues. But these arguments go to a much larger question of rights: Do people have a right to grow, raise, produce, buy, sell, cook, and eat the foods of their own choosing? Those who would answer “no” believe food rights are subject to diminution by federal, state, and local laws and regulations. Those who would answer “yes,” on the other hand, believe that food bans infringe on food choice and are therefore illegal or unconstitutional. With such great divide between these two camps, the issue of food bans is certain to continue to be a contentious one for years to come.
